Terms & Conditions of SailerClinic AG
1. Scope
These General Terms and Conditions ("GTC") apply to all services that Schlaflabor Zürich AG (the "Sleep Lab") provides to its patients in connection with diagnostic, advisory, and therapeutic services in the field of sleep medicine. The Sleep Lab and the patient are together referred to as "the Parties."
These GTC are deemed accepted once the patient accepts the offer. Within an ongoing business relationship, the GTC remain in force even if no specific reference is made to them when further services are provided. Any general terms and conditions of the patient are excluded. Any deviations from these GTC are only valid if agreed between the Parties in writing.
The Sleep Lab also provides services that are subject to specific regulations. Where mandatory statutory rules apply, they take precedence over these GTC.

The competent supervisory authority is the Health Directorate of the Canton of Zurich.
The medically responsible physician is: PD Dr. med. Rositsa Neumann, specialist in neurology FMH. She is listed in the MedReg and a member of the FMH.

3. Services
The Sleep Lab offers, in particular, the following services:
- Initial consultations and sleep-medicine assessments
- Diagnostic evaluations
- Ambulatory polygraphy
- Inpatient polysomnography (PSG)
- Multiple Sleep Latency Test (MSLT)
- Actigraphy
- CPAP titration
- Treatment recommendations and follow-up examinations
The Sleep Lab's services are provided under a mandate relationship within the meaning of Art. 394 et seq. of the Swiss Code of Obligations (CO).
Services are provided based on clinical indication and are always preceded by medical or clinical consultation.
For procedures that require informed consent (in particular inpatient polysomnography and MSLT), treatment is conditional on prior medical information being given to the patient and the patient's informed consent. Simply showing up for an appointment does not in itself constitute consent to procedures that require informed consent.
Services may also be provided without a physician's referral, where this is medically permissible and operationally feasible.
For minor patients (under 18), treatment requires the consent of the person holding parental authority. The minor's capacity for judgment is assessed under Art. 16 of the Swiss Civil Code (CC); minors with capacity for judgment may consent to their own treatment, provided the treatment is in their best interests.
For patients lacking capacity for judgment, representation follows Art. 377 et seq. CC (advance care directives, statutory representation). The Sleep Lab may require a written power of attorney or an advance care directive.
4. Information and Consent
Medical information is given orally and tailored to the situation. It covers the purpose, nature, procedure, risks, and alternatives of the planned examination or treatment.
For procedures requiring informed consent – in particular inpatient polysomnography (overnight stay, electrode placement), MSLT, and CPAP titration – patients may at any time request a written summary of the information provided. On request, the Sleep Lab will confirm the information given in writing.
Video recordings made during polysomnography or other examinations require separate, written consent that can be withdrawn at any time.
Consent may be withdrawn at any time without disadvantage. If consent is withdrawn, any examination already underway will be discontinued, provided this is medically acceptable.
5. Patient's Duty to Cooperate
Patients must inform the Sleep Lab in good time of any circumstances that are or may be relevant to the services being provided.
6. Appointments, Rescheduling, and Cancellations
Appointments may be booked or requested online, by phone, or by email.
Rescheduling is free of charge up to 48 hours before the appointment. For rescheduling between 48 and 24 hours before the appointment, a processing fee of CHF 50 may be charged.
For cancellations less than 24 hours before the appointment, or for unexcused no-shows, a missed-appointment fee may be charged:
- CHF 100 for short appointments (consultation, follow-up up to 30 minutes)
- CHF 200 for diagnostic appointments and ambulatory polygraphy
- CHF 400 for inpatient polysomnography and MSLT (full-night appointments)
For services covered by mandatory health insurance, a missed-appointment fee will only be charged to the extent it cannot be billed to mandatory health insurance.
Excused cancellations include in particular: the patient's own illness (with a medical certificate on request), illness of a dependent in the patient's care, or a documented emergency. The Sleep Lab must be informed of the excuse without delay, and no later than the scheduled appointment time.
The Sleep Lab may cancel or reschedule appointments for the following reasons: medical emergencies, staff absence due to illness, technical failure, official orders, or other significant operational reasons.
If the Sleep Lab cancels an appointment at short notice (less than 24 hours before the scheduled time) other than due to a medical emergency, force majeure, or an official order, the patient is entitled to a replacement appointment within 10 working days. Alternatively, if a missed-appointment fee was previously paid following a patient cancellation, it may be offset against the next appointment.
7. Prices and Billing
General
Prices are communicated during consultation or in line with the applicable tariffs. On request, patients receive a non-binding cost estimate before services are provided.
Prices are net, in Swiss francs (CHF), excluding any applicable statutory VAT.
Where services are covered by mandatory health insurance (OKP) and the statutory conditions are met, billing follows the applicable OKP tariffs (in particular TARDOC for outpatient medical services, in force from 1 January 2024; DRG / ST Reha for any inpatient components). Tariff changes apply from the date they take effect under the Federal Council or the competent tariff partners.
In principle, all services are covered by mandatory health insurance, provided the patient is enrolled in Swiss mandatory health insurance. For foreign patients without Swiss health insurance, services are treated as self-pay unless another arrangement applies (e.g. EU/EFTA social-security agreements or international insurance).
For certain examinations (in particular inpatient PSG and MSLT), prior cost coverage approval from the health insurer may be required. For non-urgent services that require cost coverage approval, treatment will only proceed once approval is received. For medically urgent services, treatment proceeds regardless.
Invoices are issued once the service is complete, or once reimbursement is received from the health insurer. For self-paying patients, invoicing takes place no later than 30 days after the service is provided.
Invoices are payable within 30 days of the invoice date.
Self-paying Patients
On request, self-paying patients receive a non-binding cost estimate before the examination.
A separate fee or tariff system may apply to self-paying patients (private fees in line with the cantonal medical society or individual arrangement). This is communicated before services are provided.
Cashless payment methods are accepted (cards, TWINT, bank transfer). Cash payment is available on explicit request.
The Sleep Lab is entitled to request advance payments (deposits for services yet to be provided, or payment for partial services already rendered). These are not subject to interest.
For the purpose of enforcing claims arising from the mandate relationship, the responsible physicians are released from medical confidentiality.
8. Third-party Services and Partner Companies
The Sleep Lab is entitled to involve third parties in providing its services. The contractual and business terms of the respective third party apply.
The Sleep Lab does not itself sell or rent CPAP devices. Corresponding services (device rental, mask fitting, consumables) are handled by external partner companies.
Before using services from partner companies, patients are provided with information about the companies involved and their general contractual and business terms. Use of third-party services is voluntary.
The Sleep Lab is only liable for damages arising in connection with services from third-party providers to the extent that those damages result from its own recommendation or instruction, or from inadequate instruction and/or supervision on its part.
9. Liability
The Sleep Lab is liable for direct damages caused by intent or gross negligence. To the extent permitted by law, any further liability is excluded – in particular liability for third parties it engages, liability for slight negligence, and liability for indirect, consequential, and third-party damages.
10. Insurance
The Sleep Lab carries professional liability insurance. Details of the insurance coverage are available on request.
11. Data Protection and Confidentiality
Personal data is processed in accordance with the Swiss Federal Act on Data Protection and its implementing ordinance. Full data protection information is set out in the Sleep Lab's separate privacy notice, which is available on the website and provided at registration.
Medical confidentiality and professional secrecy apply.
12. Patient Rights
Patients have, in particular, the following rights:
- The right to self-determination and informed consent
- The right to inspect their own medical record
- The right to have inaccurate data corrected
- The right to refuse or discontinue treatment at any time
- The right to referral and a second opinion
13. Complaints and Ombuds Office
Complaints should first be addressed to the Sleep Lab's management by email at info@schlaflabor-zuerich.ch. The Sleep Lab aims to resolve complaints appropriately and amicably within 20 working days.
Patients may also turn to the following external bodies:
- Ombuds Office for Health Insurance (www.ombudsman-kv.ch) for questions on insurance billing
- Cantonal Ombuds Office for Health Care, Zurich for complaints about treatment and patient rights
- Health Directorate of the Canton of Zurich as the competent supervisory authority
14. Discontinuation of Treatment and End of Therapy
Patients may discontinue treatment or end the treatment relationship at any time, without giving reasons. They are entitled to receive their patient record back or to have it forwarded to another professional.
The Sleep Lab may end treatment for important reasons, in particular if the patient persistently breaches their duty to cooperate, if the relationship of trust has broken down, or if continued treatment is no longer medically reasonable. In such cases, the Sleep Lab will arrange for ongoing care to continue (by indicating an alternative treatment option).
15. Applicable Law and Place of Jurisdiction
Swiss law applies exclusively, to the exclusion of any conflict-of-laws rules and the UN Convention on the International Sale of Goods (CISG).
The place of jurisdiction for disputes arising from this contract is Zurich, unless a mandatory statutory place of jurisdiction takes precedence.
16. Amendments to these GTC
The version of these GTC in force at the time the contract is concluded applies. The current version is available at any time on the website and will be sent on request.
Amendments to these GTC will be communicated to patients in ongoing treatment relationships in writing or by email at least 30 days in advance. If no written objection is received within that period, the amended GTC are deemed accepted.
17. Final Provisions
If individual provisions of these GTC are or become invalid in whole or in part, the validity of the remaining provisions is not affected. Any invalid provision will be replaced by a legally permissible rule that comes as close as possible to its content.
